CloudD Privacy Policy

CloudD Corporation (“CloudD” or “Cloud Utility District”) offers development tools, device connectivity tools, pre-built applications, and web services to companies looking to develop connected products or services or build mobile applications or web applications or use our pre-built applications. CloudD’s customers use our technology to build connected products and real-time data gathering solutions (oftentimes referred to as the “Internet of Things”).

This Privacy Policy (the “Policy”) applies and concerns cloudutilitydistrict.com and cloudd.io (the “Sites”) which are operated by CloudD Corporation (“us”, “we”, “our” or “CloudD”), and to CloudD technology and other web and mobile services provided by CloudD (collectively, “Services”).

Visitors to our Sites are referred to in this Policy as “Users.” Subscribers to or purchasers of our services are referred to in this Policy as “Customers.” “End Users” referred to in this policy are end users of any connected product, mobile application or web application developed by our Customers using our Services. This Policy describes and explains how we use and disclose information we collect about Users and Customers through our Sites and Services (“Personal Information”).

Users and Customers of Our Sites and Services

CloudD may collect certain Personal Information from Users and Customers of our Sites and Services. We may also receive Personal Information about End Users who use any of our Customer’s mobile apps developed using our Services.

Personal Information We Collect

We may collect certain Personal Information from Users and Customers of our Sites and Services. When Users or Customers write us a message through our Sites, the Personal Information we collect when you contact us includes your name, your email address, and any information you write in your message.

When Users or Customers create an online account with CloudD, we will collect your name and contact info, the name of your business, your email address, your login username and password, your payment and billing information, and other optional info. We also keep records of our Customers billing and account history.

Customers and users of our Sites may browse our Sites without creating an account.

End Users of Our Customers

CloudD may receive Personal Information about End Users that use our Customers’ connected products or mobile or web apps developed using CloudD’s Services.

Our Customers may collect information from End Users of their connected products built using our Services such as name, login information, email address, geographic location information, web or mobile app usage data, telemetry data, audio and video data, and other information. If our Customers manage their connected product data or web or mobile app data and information through the use of CloudD’s servers, we may receive this End User information and store it on behalf of our Customers, along with the unique identification number or device identification number we have assigned to that End User.

CloudD may store our Customers’ End User Personal Information on our servers on behalf of our Customers as part of our Services – however, this information belongs to our respective Customers, not to CloudD Corporation. Additionally, our Customers’ collection, use and disclosure of End User Personal Information is not governed by CloudD’s Privacy Policy.

How Personal Information is Used
CloudD may use the Personal Information you provide us on our Sites and through our Services for purposes such as:

  • To respond to messages or inquiries from Users and Customers sent to us through our Sites and Services, to message Users and Customers about their accounts or orders, and for similar purposes of User and Customer messaging and contact.
  • To provide our Services to Customers, such as device connectivity and control, user management, near real-time data streaming, remote device control, feedback to or communication with connected products, aggregation of End User data, and other related End User data and device data as part of our Services.
  • To provide connected product usage information to our Customers such as End User usage history, features used, general End User and device data such as geographic location and telemetry data from those devices, and other related connected product usage data.
  • For internal market research, analysis, or other purposes.
  • To process Customer payments and to charge for our Services.
  • To carry out transactions with our Customers.
  • To provide Users or Customers with useful information about our Services or to send them marketing materials of our Services.
  • To understand how Users and Customers of our Sites and Services use our technology and offerings and how they interact with our Sites and Services.
How Personal Information is Disclosed

CloudD may disclose the Personal Information we collect through our Sites and Services:

  • To contractors or service providers who provide services or perform functions on our behalf.
  • In response to a subpoena or other legal process by a governmental entity or third party, or if otherwise required by law.
  • To protect or enforce our rights or property.
  • In the event of the sale, corporate merger, acquisition, sale of assets, or dissolution of assets, in whole or in part, of CloudD Corporation or any of its affiliates.
  • To our affiliates and subsidiaries, for purposes consistent with this Privacy Policy.

CloudD may disclose End User Personal Information to the Customer who owns this Personal Information. End User Personal Information belongs to the Customer whose connected product, service, or mobile app built using our Services was used to collect such Personal Information. Assuming no violation of anything else in this Privacy Policy, our Customers may freely access and view any End User information belonging to them, and CloudD has no control over the collection, use or disclosure of this information.

CloudD may share aggregate or non-personally identifying information with third parties for marketing, advertising, research or other purposes.

What We Don’t Do with Personal Information

We will not disclose Personal Information to any third parties for such third parties’ own marketing or advertising purposes, unless we first receive your consent.

Cookies and Analytics

We use a third-party Web analytics service provider that uses cookies (i.e. a text file installed on your hard drive for collecting information about your use of a site; see below paragraph for additional info), Web Beacons (i.e. graphics with a unique identifier used to track web users), and other Web site technologies to help us analyze both how Users use our Sites and the effectiveness of our marketing search terms. The information generated by the cookie about your use of our Sites (including, without limitation, your IP address) will be transmitted to and stored by this service provider. They will use this information to evaluate your use of our Sites and compile aggregated reports for us. The information that our service provider collects and provides to us is not personally identifiable.

This Privacy Policy applies to CloudD’s Sites and Services only. Our Sites include links to other Web sites whose privacy practices may differ from those of CloudD Corporation. If you submit personal information to any of those sites, your information is subject to their Privacy Policies. CloudD Corporation’s Privacy Policy does not apply to information you may submit to those sites.

Marketing Communications

CloudD may send emails, marketing materials, or other useful information to our Users and Customers. These emails, marketing materials, and information may include information about our product offerings, promotional news about CloudD, product announcements, and other related promotional news and information.

Users and Customers who would like to stop receiving promotional emails from CloudD or newsletters or related news and promotional information from CloudD may opt-out by following opt-out instructions contained in the emails, newsletters, or related news and promotional information we have sent.

Personal Information Security

CloudD uses measures to protect the security of the Personal Information that we collect or receive through our Sites and Services, including, password protection and encryption to protect the information we collect from loss, misuse, and unauthorized access, disclosure, alteration, or destruction.

Information Stored and Processed in the United States

Information that CloudD collects through its Sites and Services will very likely be transferred to and processed in the United States of America. By using our Sites and Services, you consent to the transfer and processing of your Personal Information in the United States.

Changes to This Privacy Policy

CloudD’s Privacy Policy may change from time to time. If we change this Privacy Policy in ways that affect the personally identifying information we have collected through our site, we will post those changes in this space and advise you of choices you may have as a result of those changes. Each version of this Privacy Policy will be identified at the top by its effective date.
